conditional appearance Before 1981 a defendant could enter an appearance in qualified terms reserving the right to apply to the court to set aside the writ or service thereof for an alleged informality or irregularity. This has now been abolished. An acknowledgement of service under the new procedure does not operate as submission to the jurisdiction nor waiver of irregularities. |
